Welcome to RetroRodeo. By accessing or using our website, platform, or services (collectively, RetroRodeo), you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using the Site.
If you do not agree to these Terms, do not use our services.
- Overview
RetroRodeo is an online marketplace where users can buy, sell, and auction retro video games, consoles, and related items.
We provide the platform but are not a party to any transaction between buyers and sellers.
- Eligibility
To use RetroRodeo, you must:
Be at least 18 years old or the legal age of majority in your jurisdiction.
Create an account with accurate and current information.
Comply with all applicable local, state, and federal laws.
We reserve the right to suspend or terminate accounts that violate these Terms.
- Account Registration
Users must register for an account to list, bid, or purchase items. You are responsible for:
Maintaining the confidentiality of your login information.
All activity that occurs under your account.
Promptly notifying RetroRodeo of any unauthorized access or security breach.
- Auctions
When listing items for auction, sellers agree to:
Provide accurate descriptions and clear photos.
Set fair starting prices, bid increments, and auction durations.
Honor all winning bids unless prohibited by law or unforeseen error.
When bidding, buyers agree to:
Place bids only if they intend to complete the purchase.
Pay for won auctions promptly according to the seller’s payment terms.
All bids are binding unless otherwise stated. RetroRodeo reserves the right to cancel or suspend auctions for suspected fraud, error, or rule violations.
- Fixed-Price Sales
Sellers may also offer items for direct sale. When a buyer completes a purchase, a binding agreement is formed between the buyer and seller.
RetroRodeo does not guarantee the quality, authenticity, or legality of items listed.
- Fees and Payments
RetroRodeo may charge listing, transaction, or service fees, which will be disclosed prior to posting or completing transactions.
Payments may be processed through third-party providers (e.g., PayPal, Stripe, or other payment gateways).
RetroRodeo is not responsible for delays, chargebacks, or disputes handled by these third parties.
- Shipping and Fulfillment
Sellers are responsible for shipping sold items promptly and securely. Buyers are responsible for providing correct delivery information.
RetroRodeo is not responsible for lost, delayed, or damaged shipments unless otherwise stated in a specific policy.
- Refunds and Returns
RetroRodeo itself does not process returns or refunds; these are handled directly between buyers and sellers.
However, sellers must clearly state their refund and return policies in each listing.
If an item is not as described, damaged, or never arrives, buyers may:
Contact the seller to request a resolution.
Use RetroRodeo’s internal dispute process (if available).
Seek resolution through the payment provider’s dispute system (e.g., PayPal or credit card issuer).
RetroRodeo reserves the right to limit or revoke selling privileges from users who repeatedly fail to honor their refund or delivery obligations.
- Prohibited Items
The following items are strictly prohibited:
Counterfeit, pirated, or replica games or accessories
Stolen goods or items violating copyright/trademark laws
Dangerous or illegal items under applicable law
Listings violating these rules will be removed without notice.
- User Messaging and Content
RetroRodeo may offer direct messaging, forums, or comment features to allow users to communicate.
You agree that you will not:
Use messaging to harass, threaten, or solicit others.
Post false, misleading, or defamatory information.
Share spam, advertisements, or links unrelated to transactions.
RetroRodeo may monitor, remove, or restrict any content or messages that violate these rules, harm the platform’s reputation, or pose security risks.
Messages sent through the platform may be reviewed for fraud prevention and trust & safety purposes.
- Disputes Between Users
RetroRodeo encourages users to resolve disputes directly.
If a dispute cannot be resolved, users may contact RetroRodeo for limited mediation support.
RetroRodeo is not liable for losses, damages, or disputes between users arising from transactions.
- Intellectual Property
All RetroRodeo branding, content, and materials are the property of RetroRodeo or its licensors.
Users retain rights to their own listings and media but grant RetroRodeo a non-exclusive license to display them on the Site for marketing or operational purposes.
- Limitation of Liability
RetroRodeo provides its platform “as is” without warranties of any kind, express or implied.
We are not liable for:
User errors, fraud, or misrepresentation
System outages, data loss, or technical issues
Any indirect, incidental, or consequential damages
Your sole remedy for dissatisfaction with the platform is to discontinue use.
- Termination
RetroRodeo may suspend or terminate any account or listing that violates these Terms or disrupts the integrity of the platform.
You may delete your account at any time, though certain transaction data may be retained for legal compliance.
- Nonpayment and Account Suspension
Vendors are responsible for maintaining valid and up-to-date payment information at all times.
If a vendor’s payment is reversed, declined, or not completed for any applicable fees (including listing, transaction, or subscription charges):
The vendor’s account will be placed on inactive status after seven (7) days from the date of the failed or reversed payment.
During this period, the vendor will receive at least one notification to correct the payment issue.
While inactive, vendors will not be able to list, sell, or participate in auctions until the balance is cleared.
Continued failure to resolve the issue may result in permanent suspension and removal of listings.
A reversed payment refers to a payment that was initially processed but later taken back or undone by a financial institution, payment processor, or user dispute (such as a chargeback or failed transfer).
This is distinct from a refund, which occurs when funds are voluntarily returned to a buyer by the seller as part of a normal return process.
RetroRodeo reserves the right to recover owed fees, restrict access, and take appropriate action in accordance with these Terms and applicable law.
- Changes to These Terms
We may update these Terms at any time. Changes take effect upon posting. Continued use of the Site means you accept the updated Terms.
- Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
Any disputes arising from or related to these Terms shall be resolved in a competent court of jurisdiction within the United States.
